I gotta disagree on this one. When we allow Amazon to sell a product in TN and not collect sales tax, we give them a competitive advantage over an in state vendor.
That's fundamentally unfair. The role of government is to maintain a level playing field and this one is tilted decidedly toward online retailers.

But the problem here is, are taxes are supposed to be collected at the point of sale, which in the case of internet purchases, is not necessarily the same as the point of purchase? Where is Amazon located? The place over on VW Drive is a shipping/transfer warehouse (not unlike FedEx or UPS), not a buying/selling store. Does one pay taxes to wherever Amazon's corporate headquarters is? Or the wherever the original seller is from?

We're supposed to volunteer to pay the use tax on anything we buy from out of state... but I seem to have lost my form.

I think tax should be on all Internet purchases or none. I should not have to pay the tax because Amazon or any other Internet company chose to build in Tn. I can't go to the brick and mortar building and see it or buy it. So why should I be penalized for them choosing Tn.

I say none.
It's just a tax grab and sets a bad enterprise destroying precedent.
The 'long tail' that the internet made possible will be destroyed. How fair is that? Not.

If internet sales are so fragile that they cannot bear the weight of equal taxation, then it's an industry founded upon an unsound plan and will die accordingly.
At present, Tn loses a ton of tax revenue to internet sales. In a state that relies heavily upon sales tax to fund it's operations, that shifts an inordinate burden to retailers that can't skirt the system.
